E&LP has provided expert testimony services in support of litigation on a wide array matters; from engineering design malpractice that resulted in a fatality, to environmental liability cost recovery matters.
Our litigation support services are unique, as our expert services are foundations in civil engineering practices, not academia. Our reports are often brief, supported by fact, regulations, industry practices and bound by Professional Engineering Code of Ethics. Using these principals, it would not be unusual for us to advise our clients that our case is weak from engineering prospective, and early settlement is warranted.

Key Project Elements
Litigation resulted based on the malfunctioning of a multi-million dollar automated underground storage tank farm, as the result of surface water infiltration into the electronics of the system. The multi-compartment tanks were used to storage a wide variety of chemicals to manufacture paints.
While some water infiltrations was attributed to poor installation practices for the electronic monitors, E&LP provided expert testimony and prepared expert reports to demonstrate that a third party not involved in the litigation incorrectly installed the site pavement, resulting in an inundation of surface water during precipitation events within the tank farm. The drainage issues were rectified, and the litigation was successfully settled out of court.
